What Is a Trustee Sale?
A trustee sale — also known as a foreclosure auction — is a public sale of real property conducted by a trustee on behalf of a lender when a borrower has defaulted on a secured loan.
These sales are governed by California law and must follow strict notice requirements. Imperial Mortgage Corporation administers these sales with full compliance, transparency, and respect for all parties involved.
How the Process Works
Notice of Default
A Notice of Default is recorded when a borrower falls behind on loan payments. This begins the formal foreclosure process under California law.
Notice of Trustee Sale
At least 20 days before the sale, a Notice of Trustee Sale is recorded and published, providing the public with the date, time, and location of the auction.
Public Auction
The property is offered at public auction to the highest bidder. Sales typically take place at the county courthouse steps or a designated location.
Trustee's Deed
Upon completion of the sale, a Trustee's Deed Upon Sale is recorded, transferring title to the successful bidder or back to the beneficiary.
